Terms & Conditions

Effective Date: 12 February, 2026

These Terms and Conditions govern the provision of photography, videography, print, and production services by Langa Photography ("we," "us," "our") to you ("client," "you," "your"). By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

​

1. Services and Bookings

​

1.1 Scope of Services

 

Langa Photography provides photography, videography, print, album, and production services for personal and corporate clients. Specific deliverables, timelines, and fees will be outlined in the individual contract or quote provided to you.

 

1.2 Booking Confirmation

 

A booking is confirmed only upon:

​

  • Receipt of a signed contract or agreement; and

  • Payment of the required deposit as specified in your quote or contract.

​

1.3 Cancellation by Client

​

  • Cancellations must be submitted in writing. Cancellation fees apply as follows:

    • Less than 24 hours before the event: 100% of total package price payable.​

​

1.4 Cancellation by Langa Photography

​

  • In the unlikely event that we must cancel due to illness, emergency, or circumstances beyond our control, we will make every reasonable effort to find a suitable replacement photographer or videographer. If this is not possible, a full refund of all monies paid will be issued, and our liability shall be limited to this amount.

2. Pricing and Payments
 

2.1 Fees and Quotes

​​

  • Quote validity is stated on issued quotations. Prices are in Zambian Kwacha and exclude applicable taxes unless stated otherwise.

​

2.2 Payment Schedule

 

Unless otherwise agreed in writing:

​

  • A non-refundable deposit of 50% is required to secure your booking.

  • The remaining balance is due 7 days prior to the event.

​

2.3 Late Payments

 

  • If payment is not received by the due date, we reserve the right to place a hold on the delivery of images, videos, and products until the outstanding balance is cleared. Late payments may incur a 10% administration fee.

​

3. Shoot Day and Deliverables
 

3.1 Client Responsibilities

 

You agree to:

  • Obtain all necessary permissions, licenses, and consents for the shoot location and subjects.

  • Ensure the safety and suitability of the shoot environment.

  • Provide accurate timings, schedules, and contact information.

​

3.2 Timing

 

  • Our team will arrive and depart as agreed in your contract. Delays caused by the client or circumstances beyond our control may affect deliverables. We will not be liable for outcomes resulting from such delays.

​

3.3 Force Majeure

​

  • We shall not be held liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, pandemics, or technical failures.

​

3.4 Delivery Timeline

​

  • Edited images and/or video content will be delivered within the timeframe specified in your contract. Should no timeline be specified, delivery will occur within 2 weeks from the shoot date. Express orders may be available upon request and may incur additional fees.

4. Copyright and Intellectual Property
 

4.1 Ownership of Images

 

  • Langa Photography retains full copyright ownership of all images, footage, and creative works produced during our engagement. The client receives a license to use the delivered materials as outlined in Section 4.2.

​

4.2 Usage License

​

  • Upon full payment, the client is granted a non-exclusive, perpetual, worldwide license to:

  • Print, share, and display the images and footage for personal, non-commercial use; or

  • Use the images and footage for the specific commercial purposes outlined in your contract.

  • This license is non-transferable unless explicitly agreed in writing.

4.3 Restrictions

​

  • Unless otherwise agreed in writing, the client may not:

  • Sell, license, or commercially exploit the images or footage beyond the scope agreed in the contract.

  • Edit, alter, or apply filters to our work in a way that misrepresents our brand or creative integrity.

  • Use our images or footage in a manner that is defamatory, unlawful, or harmful.

4.4 Marketing and Portfolio Use

​

  • Unless you notify us otherwise in writing, Langa Photography reserves the right to use your images and footage for marketing and promotional purposes, including but not limited to our website, social media, print materials, portfolio, and submissions to awards or publications. You may opt out of such use at any time by contacting us in writing.

4.5 Client-Generated Content

​

  • Any logos, trademarks, or copyrighted materials you provide for incorporation into our work remain your property. You warrant that you have the legal right to use such materials and grant us permission to reproduce them in your deliverables.

​

5. Image Processing and Archiving
 

5.1 Creative Direction

​

  • The artistic interpretation of your images and footage is the responsibility of Langa Photography. We apply our professional judgment in editing, colour grading, and selecting final deliverables. No two photographers or videographers see the same moment identically, and we do not guarantee that every image captured will be delivered.

 

5.2 Archiving

​

  • We retain client image and video files for a period of 3 months following project completion. After this period, files may be permanently deleted. It is your responsibility to back up and preserve your final deliverables.

 

6. Prints and Products
 

6.1 Product Quality

 

  • We partner with trusted laboratories and manufacturers to produce prints, albums, and other physical products. While we strive for colour and finish accuracy, slight variations may occur due to differences in monitor calibration and production processes.

 

6.2 Damaged or Defective Products

 

  • If a product arrives damaged or defective, please notify us within 2 days of receipt. We will work with our partners to arrange a replacement or refund at our discretion.

7. Limitation of Liability

​

  • To the maximum extent permitted by law:

  • Our total liability to you shall not exceed the total fees paid by you for the specific service giving rise to the claim.

  • We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill.

  • We are not responsible for the failure of third-party platforms, printing labs, or delivery services.

 

8. Indemnification

  • You agree to indemnify and hold Langa Photography harmless from any claims, damages, losses, liabilities, costs, and expenses arising out of:

  • Your breach of these Terms and Conditions.

  • Your violation of any applicable law or third-party right.

  • Any claim that materials you provided infringe upon third-party copyright or intellectual property.

 

9. Privacy

  • Our collection and use of your personal information is governed by our Privacy Policy, available on our website or upon request. By engaging our services, you consent to the practices described in that policy.

 

10. Dispute Resolution
 

10.1 Informal Resolution
 

  • If a dispute arises, both parties agree to first attempt to resolve the matter informally through good-faith discussions.

 

10.2 Mediation

  • If informal resolution fails, both parties agree to submit the dispute to mediation at a mutually agreed location before pursuing any other remedies.

 

10.3 Governing Law

 

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Zambia. Both parties submit to the exclusive jurisdiction of the courts located in Zambia.

 

11. Amendments

 

  • We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The version applicable to your engagement is the version in effect at the time your booking was confirmed.

 

12. Severability

 

  • If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

 

13. Entire Agreement

 

  • These Terms and Conditions, together with your signed contract or quote, constitute the entire agreement between you and Langa Photography and supersede all prior understandings, representations, or agreements, whether written or oral.
